Exclusive.     The photographer named in the contract shall be the exclusive photographer retained by the client for the purpose of photographing the wedding or family shoot.  Family and friends will be permitted to take pictures as long as they do not interferer with the photographer and the duties.  Formal shots arranged by the photographer shall not be permitted to be photographed by any other person except the photographer.

Deposit and Payment.   The client will pay a deposit of 40% of the package price to retain the photographer for services when the contract is signed.  The deposit shall be applied to the remaining balance due.

Cancellation.  If the client cancels the agreement in 90 or more calendar day of the wedding date, any deposit paid from the wedding package will be refunded to the client.  If the client cancels within 90 days of the wedding, the deposit will NOT be refunded.

Photographic Materials.  All photographic materials, including but not limited to negative, transparencies, proofs and previews are the exclusive property of the photographer. The proof sheet will be available within 4 weeks from the wedding date.

Copyright and reproductions.  The photographer owns the copyright of all images and has the exclusive right to make reproductions.

Client’s usage.  The client will obtain prints for personal use only, and will not sell said prints or authorize reproduction thereof by parties other than the photographer.

Failure to perform.  If the photographer cannot perform as agreed due to fire or other causality beyond the control of the parties, the photographer shall return the deposit to the client and the client will have no further liability with respect the other agreement. The limitation shall also apply to material lost due to processing, camera malfunction, lost in the mail, or damaged without fault of the photographer.

Photographer.  The photographer may substitute another photographer to take photographs due to even of photographer’s illness or scheduling conflicts.  In the event of substitution, the photographer warrants the photographs taken by the substitution.

Inherent Qualities.  The client shall be aware of color dyes in photography may fade or discolor over time due to inherent qualities of dyes. The client releases the Photographer of any liability for any claims whatsoever based upon fading and discoloration.

Pricing List.  The charges in the agreement are based on the standard price list of the photographer.  The price list shall be evaluated periodically and adjusted accordingly.  Future orders shall be charged the current price list.

Client’s originals.  If the client providing original prints, negative or transparencies owned by the client to the photographer for duplication, framing, reference or any other purpose, in the even of loss or damage the Photographer is not liable for an amount is excess $5 per image.

Miscellaneous.  This agreement incorporates the entire understanding of the parties.  Any modification of this agreement must be in writing and signed by both parties.  Any wavier of a breach or default hereunder shall be deemed a wavier of a subsequent breach or default of either the same provision or any other provision of the Agreement. Their agreement shall be governed by the laws of the State of Illinois
